Their spokesmen, Pablo S\u00e1nchez from \u201cTodos Tiene Derechos\u201d (Everyone has rights) (TTD) and Yesenia Alvarez from the Political Institute for Freedom (IPL), called on leaders, academics, activists, youth and civil society organizations to join in the collection of signatures in order to present an action of unconstitutionality in favor of this proposal.<\/p>\n<p align=\"justify\">Through the Rights for Everyone campaign, several organizations are proposing to file an unconstitutionality action by omission in order to suppress those words of the article 326 of the Civil Code and article 1 of Law 30007 which prevent any couple, regardless of their sexual orientation, can constitute a stable union indeed with effects similar to those of marriage. According to their spokesmen, the current wording of both articles discriminates, delimits and violates the constitutional rights of identity, free development of personality, equality and ownership of homosexual couples.<\/p>\n<p align=\"justify\">Yesenia Alvarez commented that up to now, a chance to approve the civil union or the egalitarian marriage has been tried through the parliament and that, by a conservative majority reluctant to recognize equality before the law of the homosexual community, it did not succeed. She explains that, as the way the current parliament is, the approval of any of those won\u2019t happen in the next five years. These efforts have been valuable but it is necessary to bring the debate to a new path: the constitutional one.<\/p>\n<p align=\"justify\">One of the major attractions of this initiative is that it does not depend on the Congress and can even be achieved this year, as it would be submitted directly to the Constitutional Court and it does not dependent on politicians, but directly from civil society.<\/p>\n<p align=\"justify\">According to the legal team of TTD, led by Pablo S\u00e1nchez, the next step is to collect 5,000 signatures, a minimum amount required by the Constitutional Procedural Code to file an unconstitutionality action. To achieve this, both organizations have invited all civil society to participate and be protagonists of this historic legal action.<\/p>\n<p align=\"justify\">Yesenia Alvarez pointed out that this initiative will allow seek for equality before the law for same-sex couples, with the population support after so many years of indifference coming from our parliamentarians.<\/p>\n<p align=\"justify\">It should be noted that in the IPSOS survey conducted in 2014, it showed that the majority of Peruvians are in favor of recognizing the patrimonial rights of same-sex couples. 54% of Peruvians believed that gay couples should have access to health insurance if their partner&#8217;s insurance allows it; While 52% believe that a partner should be able to make decisions in medical emergencies; 52% believe that they should be able to access their partner&#8217;s pension and 49% believe that they should be able to form a common economic heritage that allows them to inherit when their partner grows older.<\/p>\n<p align=\"justify\">Leaders of the Rights for Everyone campaign said that their intention is to help ensure that any couple, regardless of sex or sexual orientation, can establish a de facto union with marriage-like effects as soon as possible. With this, they hope to help Peru be more free and respectful of the life projects and constitutional rights of all Peruvians. Sus voceros, Pablo S\u00e1nchez de <em>Todos Tenemos Derechos (TTD) <\/em>y Yesenia Alvarez del <em>Instituto Pol\u00edtico para la Libertad (IPL<\/em>), convocaron a l\u00edderes, acad\u00e9micos, activistas, j\u00f3venes y organizaciones de la sociedad civil a sumarse a la recolecci\u00f3n de firmas para poder presentar una acci\u00f3n de inconstitucionalidad a favor de esta propuesta.<\/p>\n<p style=\"text-align: justify;\">Mediante la campa\u00f1a <em>Derechos para Todos,<\/em> varias organizaciones plantean presentar una acci\u00f3n de inconstitucionalidad por omisi\u00f3n para suprimir aquellas palabras del art\u00edculo 326 del C\u00f3digo Civil y el art\u00edculo 1 de la Ley 30007 que impiden que cualquier pareja, independientemente de su orientaci\u00f3n sexual, pueda constituir una uni\u00f3n estable de hecho con efectos similares a los del matrimonio. Seg\u00fan sus voceros, la redacci\u00f3n actual de ambos art\u00edculos discrimina, delimita y viola los derechos constitucionales de identidad, libre desarrollo de la personalidad, igualdad y propiedad de las parejas homosexuales.<\/p>\n<p style=\"text-align: justify;\">Yesenia Alvarez coment\u00f3 que hasta la fecha se ha intentado aprobar la uni\u00f3n civil o el matrimonio igualitario a trav\u00e9s del parlamento y que, por una mayor\u00eda conservadora reacia a reconocer la igualdad ante la ley de la comunidad homosexual, no prosper\u00f3. Explica que, tal como est\u00e1 actualmente el parlamento, parece que no prosperar\u00e1n en los pr\u00f3ximos cinco a\u00f1os. Que esos esfuerzos han sido valiosos pero que es necesario llevar el debate a una nueva v\u00eda: la constitucional.<\/p>\n<p style=\"text-align: justify;\">Uno de los mayores atractivos de esta iniciativa es que no depende del Congreso e incluso puede lograrse este mismo a\u00f1o, ya que se presentar\u00eda directamente ante el Tribunal Constitucional y no depende de pol\u00edticos, sino directamente de la sociedad civil.<\/p>\n<p style=\"text-align: justify;\">De acuerdo al equipo legal de TTD, liderado por Pablo S\u00e1nchez, el siguiente paso es recolectar 5,000 firmas, cantidad m\u00ednima que exige el C\u00f3digo Procesal Constitucional para presentar una acci\u00f3n de inconstitucionalidad. Para lograrlo ambas organizaciones han invitado a toda la sociedad civil a que participen y sean protagonistas de esta acci\u00f3n legal hist\u00f3rica.<\/p>\n<p style=\"text-align: justify;\">Yesenia Alvarez puntualiz\u00f3 que esta iniciativa permitir\u00e1 buscar la igualdad ante la ley para las parejas del mismo sexo, con el respaldo popular despu\u00e9s de tantos a\u00f1os de indiferencia de nuestros parlamentarios.<\/p>\n<p style=\"text-align: justify;\">Cabe se\u00f1alar que en la encuesta de IPSOS realizada en el a\u00f1o 2014, demostr\u00f3 que la mayor\u00eda de peruanos est\u00e1 a favor del reconocimiento de los derechos patrimoniales de las parejas del mismo sexo. El 54% de los peruanos cre\u00eda que las parejas homosexuales deben de tener acceso a un seguro de salud si es que el seguro de su pareja lo permite; mientras que el 52% cree que un miembro de la pareja deber\u00eda de poder tomar decisiones en emergencias m\u00e9dicas; el 52% creen que deber\u00edan de poder acceder a la pensi\u00f3n de su pareja y el 49% opina que deber\u00edan de poder formar un patrimonio econ\u00f3mico en com\u00fan, que les permita heredar cuando envejezca su pareja.<\/p>\n<p style=\"text-align: justify;\">Los l\u00edderes de la campa\u00f1a \u201cDerechos para Todos\u201d se\u00f1alaron que su intenci\u00f3n es contribuir a que lo m\u00e1s pronto posible cualquier pareja, sin importar su sexo u orientaci\u00f3n sexual, pueda establecer una uni\u00f3n de hecho con efectos similares al matrimonio. Con esto, esperan ayudar a que el Per\u00fa sea m\u00e1s libre y respetuoso con los proyectos de vida y los derechos constitucionales de todos los peruanos.
